Legislative Effort, Transparency in Special Education

Talking Points/Explanation

The legislation would direct the Department of Education to make the change proposed below. This change to the Department of Education regulations is extremely important because:

• Over 67,000 students in Iowa must go through special needs consultations every year
• After each consultation, the data, notes, or information discussed can take weeks or even months to reach parents
• These data, notes, or information is ABOUT THE PARENTS' KID - they should have a right see that data immediately
• Parents cannot support their children or the school if they are not fully informed
• For every month a parent stays uninformed of a child's needs, that child falls further and further behind
• The best schools in Iowa share information from these consultations in near real time

THIS LEGISLATION would:

• require all schools to share information that could help parents help their students as soon relevant data is created or received
• essentially copy what great schools already do in real time, and requiring ALL schools to have access to that information as soon as reasonable so parents can help raise their kids more effectively

41.312(2) Nature of general education interventions. General education interventions shall include consultation with special education support and instructional personnel. General education intervention activities shall be documented and shall include measurable and goal-directed attempts to resolve the presenting problem or behaviors of concern, communication with parents, collection of data related to the presenting problem or behaviors of concern, intervention design and implementation, and systematic progress monitoring to measure the effects of interventions.

All comments, assessment results, notes, conclusions, proposed actions, or any recorded communications of the consultation shall be securely shared with all participating parties at the time of creation or receipt.
